PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE USING OURWEBSITE, BOOKING OR RECEIVING, AND/OR PURCHASING, SERVICES, OR PRODUCTS, OR USING THE FACILITIES. THESE TERMS AND CONDITIONS INCLUDE A CLASS ACTION AND JURY WAIVER.

These terms and conditions are entered into by and between You and NAOSU Thermaculture, LLC, d/b/a NAOSU SAUNA (“NAOSU”, “NAOSU SAUNA”, “Company,” “we,” or “us”), together with the Waiverof Liability, Release, Hold Harmless and Assumption of Risk Agreement, Membership Agreement, Policies and Rules, the Terms of Use, and the Privacy Policy, which are expressly incorporate by this reference (collectively, “Terms and Conditions” or “Terms” or “Agreement”), govern your access to and use of our website located at www.naosusauna.com (the “Website”), the NAOSU’s facilities, which include any and all areas of the premises, all equipment including, but not limited to, sauna, cold plunge, tea experience, any other services, by NAOSU or an independent contractor(s), and related activities, (together the “Facilities”), whether as a guest, visitor, member, employee, staff or vendor. By accessing or using this Website or the Facilities, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use this Website.

1. Age and Capacity Requirement: By entering or using this Website and the Facilities You represent and warrant that you are at least 18 years of age and have the power and authority to enter a binding contract with us and are not barred from doing so under any applicable laws into and perform your obligations under this Agreement. Entrance to the Facilities is restricted to guests who are at least 18 years of age or older. NAOSU reserves the right to deny entry to the Facilities of anyone who is unable to provide proof of age. You also promise that any information that you submit to NAOSU is true, accurate and complete, and you agree to update us if your information changes. You have provided and will provide accurate and complete registration information, including, without limitation, your legal name, email address and telephone number.

2. ‍Account: ‍In order to use the Facilities, you must create an account. When registering for an account, you must provide truthful, accurate and complete information and promptly update this information to keep it current. If you provide any information that is false, inaccurate or incomplete, or we have reason to believe that the information you provide is false, inaccurate or incomplete, we may suspend or terminate your account and your use of the Facilities and activities. Users may not share, give or sell their password or username to any other person or entity. Excessive viewings or logins to an account by any user will be construed by NAOSU as fraudulent use, which will result in the immediate cancellation of the membership without a refund. We reserve the right to cancel any membership which we believe has been compromised, or is being used fraudulently, at our own discretion.

3. Health, Allergies or Pregnancy Considerations: You must be in general good health, and not under the influence of alcohol, or drugs to use the sauna and cold plunge, or any services. The sauna and cold plunge are intended only for enjoyment and general wellness purposes and are not intended to substitute professional medical treatment for any condition, medical or otherwise, that you may have. If you have any existing medical conditions you are advised to consult your doctor before using the Facilities or services from us.

  • You agreed to and have signed/accepted the Waiver of Liability, Release, Hold Harmless and Assumption of Risk Agreement, which is part of these Terms.

  • You will notify our staff immediately of any discomfort experienced during your use of the sauna or cold plunge, or any service.

  • We do not give any guarantee to any desired results or outcomes from our sauna or cold plunge, or any other product or service.

4. Payments and Authorization. We accept debit cards and the following major credit cards: Visa, Mastercard and American Express, as methods of payment for our products and services. By using a credit card at our Facilities or Website, you represent and warrant that you have the authority to use that credit card for the request, booking, or purchase. NAOSU reserves the right to cancel any booking or appointment or any other transaction that it reasonably believes to have been fraudulently made, including by unauthorized use of a credit or debit card.

5. Cancellations and Rescheduling. NAOSU maintains a strict cancellation policy. If you need to cancel or reschedule any booking or appointment, you must provide advance notice of at least 24 hours prior to the original date and time of the reserved booking or appointment for the service.

  • To cancel or reschedule any group bookings of four or more guests, you must provide at least 7 days advance notice.

  • If you cancel or reschedule within 24 hours or less (or, if applicable, within 7 days), you will be considered a No-Show and you will be charged No-Show fee of 100% of the cost of the booking or service. The No-Show fee will be charged to the credit card that you used to make the booking or appointment(s).

  • Exchanges and Refunds: With the exception of group bookings of four or more guests, if you cancel or reschedule 24 hours prior to the commencement of your booking or appointment for your services, you will be able to receive an exchange or refund.

Cancellation by NAOSU: NAOSU reserves the right to cancel the booking or appointment for a service. NAOSU may offer you an alternative accommodation of the same standard or offer a full refund. NAOSU is not responsible and will not pay any compensation or provide any reimbursement of any expenses or costs you may incur as a result of any such cancellation or change.

6. Refund Requests: If you are dissatisfied with any service received at NAOSU, or any other aspect of your visit, for any reason, please notify a member of the NAOSU staff before leaving the Facilities. This allows us to promptly investigate and address any issues or concerns. No refunds will be issued for complaints not raised to the NAOSU staff within 24 hours of your visit.

7. ‍Membership: NAOSU offers membership to use the Facilities for a fee. These are the following types of memberships: 1 Month Unlimited and 3 Month Unlimited memberships. Subject to your payment of fees for a membership, and compliance with all the terms of the Membership Agreement and this Terms and Conditions, that include all the terms of the Waiver of Liability, Release, Hold Harmless and Assumption of Risk Agreement, the Policies and Rules, the Terms of Use, and the Privacy Policy, which are incorporated herein and are, part of, and collectively referred as, the Terms and Conditions, you will be able to use the sauna or cold plunge according to your type of membership. NAOSU reserves the right to cancel your Membership at any time if you make any misrepresentations or are found to be in violation of any of the Terms and Conditions. Memberships are billed on a periodic basis as specified at the time of purchase (e.g., monthly or yearly). Your membership subscription will continue in effect on a recurring basis corresponding to the term of your subscription unless and until you cancel your subscription or the account, or the service is otherwise suspended or discontinued, pursuant to this agreement. If your membership is cancelled or terminated before the end of the applicable billing cycle, NAOSU will not reimburse you for the remainder of that paid month. Members may cancel their membership at any time. Membership must be canceled prior to the renewal date in order to avoid additional membership charges. When you purchase a membership, you will initially be charged at the rate applicable at the time of your agreement to become a member. If NAOSU later increases the price of the membership, we will notify you via email. We reserve the right to change the price of our membership at any time, and will attempt to notify you via email with at least 30 days’ notice. Founding Member rates will be locked in for the continuous duration of the membership. Cancelling, termination, or allowing the lapse, of your Founding Membership, will immediately forfeit your Founding Member rate. If you decide to rejoin NAOSU as a member, your new membership rate will be based on the then current applicable rate. We require that you provide a valid credit or debit card at the time you register to become a member to ensure that you have continued access to your membership. You agree to keep a valid credit card or debit card and authorize NAOSU to charge the membership fee according to you type of membership. You may only use a free visit once. NAOSU is a non-refundable membership subscription service. We do not refund any unused time or services. We trust our members to keep track of their subscriptions and to adhere to the Terms and Conditions agreed to upon registration, an updated Terms and Conditions once they become accepted.

8. ‍Consent to Electronic Communications: ‍By using the Facilities, you consent to receiving electronic communications from us. These communications may include notices about your account, membership, and information concerning or related to the service. You agree that any notices, agreements, disclosures, or other communications that we send to you electronically will satisfy any legal communication requirements, including that such communications be in writing. You are solely responsible for all fees charged by your telecommunications service provider or any other service provider related to your use of the service, including without limitation any SMS/text messaging fees, data charges, and other fees.

9. Photography and Video: You are not allowed to use your phone or mobile device, or any electronic device, to take pictures or videos of staff or other guests while at the sauna or cold plunge. If you are caught using your phone or mobile device, or any electronic device in such instance, you may be asked to leave the Facilities, without the right to a refund. Photography and/or video for commercial or other non-personal uses is strictly prohibited within the Facilities, and will result in your removal from the Facilities. If you wish to take photos or video for such purposes at our Facilities, please contact info@naosusauna.com to discuss possible arrangements at least thirty (30) days in advance of your visit.

10. Personal Property: Keep all valuables and personal items with you and do not bring any valuables to the Facilities. You may use the cubbies in the changing rooms for your clothing items while you are using the sauna or cold plunge. NAOSU has no responsibility whatsoever, and cannot be held liable directly or indirectly, for any personal property, including valuables, that you bring to the Facilities, regardless of whether such property is lost, stolen, damaged or left behind. Any undergarments left behind will be promptly disposed of.

11. Warranty Disclaimer.

NAOSU MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND OR NATURE, EITHER EXPRESS OR IMPLIED, AS TO ANY MATTER

NAOSU SAUNA POLICIES AND RULES

By using the NAOSU SAUNA facilities, which include any and all areas of the premises, all equipment including, but not limited to, sauna, cold plunge, tea experience, and related activities, (together the “Facilities”) you agree to follow these Admission, Cancellation, Sauna and Cold Plunge, policies and Cold Plunge and Sauna rules (together the “Policies and Rules”). Violation of these Policies and Rules may result in your removal from this Facility and/or suspension or termination of your membership. NAOSU SAUNA reserves the right to modify/change these Policies and Rules without prior notice. NAOSU SAUNA reserves the right to remove any person from the premises and/or revoke/suspend/terminate the membership of any member who fails to follow these Policies and Rules, or for any reasons of nuisance, disturbance, moral turpitude or fraud. Refunds will not be provided in any of these instances.

Admission Policy

  • The Facilities are an Adult-only facility. You must be 18 years old to enter and use the Facilities. No exceptions.

  • A valid government-issued ID is required for check-in for all guests. No exceptions.

  • Each visit is limited to an hour session.

  • No one under the influence of alcohol or drugs is allowed to enter the Facilities.

  • NAOSU SAUNA reserves the right to deny entry or use of the Facilities to any person overconcerns for health and/or safety risks. You may be requested to provide a letter from your physician.

  • Alcoholic beverages or illegal drugs are not permitted at the Facilities. If anyone is believed to be under the influence of alcohol or drugs, NAOSU SAUNA reserves the right to deny entry and/or remove that person from the Facilities and contact the local authorities.

  • The taking of pictures or videos of others is strictly prohibited at the Facilities. Anyone doing so will be asked to leave the Facilities.

  • The Facilities are a low noise relaxing environment. Please help keep an enjoyable experience by keeping noise to a minimum, and talking in a low voice while at the Facilities.

  • No outside food and/or drinks are permitted in the Facilities. Food and/or drinks purchased at the Facilities are permitted only in designated lobby and lounge areas, but not in the sauna or cold plunge areas. Water in an enclosed bottle not made of glass is permitted.

  • Do not bring your cell phone inside the sauna or cold plunge area. Cell phone use in the Facilities is strongly discouraged.

  • All personal items and clothing must be placed in the cubbies. NAOSU SAUNA is not responsible for personal items that are lost, stolen, or left at the Facilities.

  • Any form of unruly behavior or inappropriate activity will cause your removal from the Facilities.

  • NAOSU SAUNA reserves the right to cancel any session, close and/or restrict access to any area of the Facilities without prior notice.

Policy on Nicotine and Legal Marijuana Consumption

  • The Facilities are smoke free. In the interest of providing a safe, legal, and healthy environment for our guests and staff members, the use of tobacco and/or other nicotine products, including but not limited to smokeless tobacco or e-cigarettes, is not permitted at the Facilities. Marijuana consumption in any form is also prohibited at the Facilities.

Cancellation Policy

  • Cancellations must be made at NAOSU SAUNA website or by emailing: info@naosusauna.com.

  • All cancellations require an advance notification of at least 24 hours prior to the original date and time of the reserved service.

  • Group booking of 4 or more guests requires a minimum 7-day advance notification.

  • No-shows will be charged at 100% of the cost of the session. There will be no refunds.

Sauna and Cold Plunge Policy

  • Sessions start promptly as scheduled.

  • Drinking plenty of water before, during, and after your session is recommended.

  • A bathing suit is required to use the sauna and cold plunge.

  • Showering before entering the sauna and cold plunge is required.

  • No footwear while inside the sauna, or by the cold plunge.

  • Nudity, alcohol, drugs, and smoking are not permitted.

  • To reduce the risk of burning, jewelry should not be worn while in the sauna.

  • The taking of pictures or videos of other guests is strictly prohibited.

  • The door of the sauna must be kept shut.

  • Caution must be used when entering and exiting the sauna and cold plunge.

  • If prior to your session you are feeling unwell, or think you may be getting sick, please reschedule your session.

  • Listen to your body and continually check-in with yourself.

  • Please IMMEDIATELY stop your sauna/cold plunge session if you begin to feel unwell and alert a staff member.

  • Used towels must be placed in the provided hampers.

Rules for Sauna usage

You acknowledge and agree that:

1. You are 18 years of age or older, in good health and not under the influence of alcohol or drugs.

2. You have agreed to NAOSU SAUNA Waiver of Liability, Release, Hold Harmless and Assumption

of Risk Agreement before using the cold plunge.

3. You will follow all these rules and all posted and verbal instructions to safely use the sauna.

4. You will immediately obey any request to exit the sauna.

5. You will not remain in the sauna past your session time.

6. You will not tamper with the temperature controller and/or settings of the sauna.

7. You have no physical issues, or history of physical issues, which could impair your ability to utilize the sauna in a safe manner.

8. You are responsible of your wellbeing while using the sauna and You will exit the sauna

IMMEDIATELY if you feel nauseous, dizzy, or uncomfortable.

Rules for Cold Plunge Usage

You acknowledge and agree that:

1. You are at least 18 years old, in good health and not under the influence of alcohol or drugs.

2. You have agreed to NAOSU SAUNA Waiver of Liability, Release, Hold Harmless and Assumption

of Risk Agreement before using the cold plunge.

3. You will follow all these rules and all posted and verbal instructions to safely use the cold plunge.

4. You will not introduce bodily fluids or other chemicals into the water of the cold plunge. You will be charged and must pay a cleaning fee of $5,000, if You violate this rule.

5. You will not remain in the cold plunge past your session time.

6. You will immediately obey any request to exit the cold plunge.

7. You will not remove, or tamper with, any part of the cold plunge.

8. You have no physical issues, or history of physical issues, which could impair your ability to utilize the cold plunge in a safe manner.

9. You are responsible of your wellbeing while using the cold plunge and You will exit the cold plunge IMMEDIATELY if you feel nauseous, dizzy, or uncomfortable.

NAOSU SAUNA reserves the right to change the Policies and Rules or implement new policies without advance notice.
